Unvaulted Games – Terms of Service
Welcome to Unvaulted Games. By purchasing products, visiting our website, or engaging with us at events, you agree to the following Terms of Service. Please read carefully.
1. General
  • All items sold by Unvaulted Games are subject to these Terms of Service.
  • We are a small business specializing in retro and modern video games and related merchandise.
  • All sales are final unless otherwise stated in our Returns & Warranty Policy.
2. Orders
  • By placing an order, you confirm that all information provided is accurate and complete.
  • We reserve the right to refuse service or cancel orders for any reason, including suspected fraud or misuse.
  • Payment must be completed at the time of purchase.
3. Pricing & Availability
  • Prices are subject to change without notice.
  • Inventory is limited; we cannot guarantee availability after an order is placed.
  • We are not responsible for typographical errors or inaccuracies in pricing or product descriptions.
4. Shipping, Delivery & International Tariffs
  • Shipping policies and costs are outlined in our Returns & Warranty Policy.
  • Delivery times are estimates and not guaranteed.
  • Customer Address Accuracy: Customers are responsible for providing a correct shipping address. Packages shipped to an incorrect address provided by the customer are not eligible for refunds or replacements.
  • International Duties & Tariffs: All international shipments may be subject to import duties, taxes, tariffs, and customs clearance fees levied by the destination country. These fees are not included in our product prices or shipping charges. The recipient (the buyer) is the importer of record and is solely responsible for paying all duties, taxes, and clearance fees required to release the package from customs.
  • Obligation to Accept Delivery: By placing an order, you agree to accept delivery of the package and cooperate fully with the shipping carrier and customs authorities.
  • Refused or Unclaimed Packages: If an international delivery is refused by the customer (including, but not limited to, refusal to pay mandatory import tariffs/duties) or remains unclaimed at the local courier depot, the package may be automatically routed back to our facility. In the event of a refused or abandoned shipment, the following terms strictly apply:
    • Non-Refundable Shipping: The original shipping fee paid at checkout is completely non-refundable.
    • Deduction of Return Costs: Any return shipping charges, penalty fees, or import tariffs charged back to Unvaulted Games by the carrier or customs to return the package to our warehouse will be deducted directly from the customer’s total order refund.
    • Restocking & Processing Fee: A restocking fee of 10% will be deducted from the refund. This fee covers non-refundable credit card processing fees incurred during the initial transaction and labor costs.
    • Refund Processing: Refunds for refused shipments will only be processed after the physical inventory has safely arrived back at our facility and has been inspected. If return fees, tariffs, and restocking fees exceed the total value of the order, no refund will be issued.
5. Returns, Refunds & Warranty
  • Please review our Returns & Warranty Policy, which is incorporated into this TOS by reference.
  • In summary: No returns or refunds unless we shipped the wrong item or it is defective.
  • Approved warranty claims are covered for 30 days from the date of purchase.
  • Condition of Returns & Item Integrity: Any approved return, exchange, or warranty claim must include all original packaging, manuals, inserts, registration slips, and bonus materials. For factory-sealed modern games, limited editions, or trading card products (TCGs), returns are strictly void if the original factory plastic wrap, seal, or security tape has been broken, opened, or altered in any way.
6. User Responsibility & Hardware Disclaimer
  • Buyers are responsible for ensuring region compatibility (NTSC / PAL / NTSC-J), system requirements, and necessary accessories before purchasing software.
  • Misuse, accidental damage, or physical modifications to items after delivery are not covered by our warranty.
  • Third-Party Modifications & Accessories: Unvaulted Games is not liable for damage caused to our cartridges, discs, or hardware by modified consoles, third-party accessories, unauthorized clone systems, or improper voltage adapters. It is the buyer's responsibility to ensure their console hardware is original and operating safely before inserting software.
7. Intellectual Property
  • All website content, including text, images, logos, and branding, is the property of Unvaulted Games.
  • You may not copy, reproduce, or distribute content without our written permission.
8. Limitation of Liability
  • Unvaulted Games is not responsible for indirect, incidental, or consequential damages arising from the purchase or use of products.
  • We are not liable for compatibility issues, shipping delays, or damage caused after delivery.
9. Fraud, ID Verification & Chargebacks
  • We reserve the right to request additional identification or payment authorization verification for high-value, duplicate, or flagged transactions before fulfillment. Failure to comply with verification within 48 hours will result in immediate order cancellation and refund.
  • We reserve the right to dispute false claims or chargebacks using order records, communication histories, electronic signatures, tracking information, and photos of shipped items.
  • For high-value shipments, a physical signature upon delivery is required. Delivery proof containing a physical signature at the designated shipping address serves as final, binding proof of order fulfillment.
10. Governing Law
  • These Terms of Service are governed by the laws of British Columbia, Canada.
  • By using our services, you agree to submit to the jurisdiction of the courts of British Columbia for any disputes.
